Social Security has processed 420,549 benefits for birth and child care between April and December 2019

These Social Security benefits replaced those of maternity and paternity as of the approval of the Royal Decree-Law 6/2019 of March 1 urgent measures to guarantee equal treatment and opportunities between women and men in employment and occupation. This same Royal Decree established a transitional period for the total equalization of both permits that culminates in 2021.

Between April and December of last year, 185,077 benefits for birth and child care have been enjoyed by the first parent, usually the mother, and 182,272 by the second (in most cases, the father). Of the 185,077 benefits enjoyed by the first parent, 2,805 have been shared with the second.

By autonomous communities, the largest number of processes between April and December has corresponded to Catalonia (75,431), Andalusia (73,091), Madrid (69,288) and Comunidad Valenciana (40,654).

Social Security has dedicated 1,673.58 million euros to the payment of these tax benefits in those three quarters. During that period, the leave corresponding to paternity was extended to 8 weeks.

From January 1, 2020, the permission of the second parent in case of biological birth amounts to 12 weeks, with four mandatory after birth in case of birth and the rest voluntary. The mother, who is 16 weeks old, can give her father two weeks of leave. In the case of adoption, custody or foster care, each parent will have 6 mandatory weeks from the judicial decision or administrative decision and 16 voluntary weeks to be distributed between the two, with a maximum of 10 weeks for one of them.

It is expected that in 2021 this benefit, equal for both parents, will be recognized as an individual and non-transferable right. It will be 16 weeks and 6 of them must be enjoyed after delivery or judicial or administrative resolution in case of adoption, guardianship or foster care.

The amount of these benefits is equivalent to one hundred percent of the salary and is paid directly by the National Institute of Social Security (INSS) during the weeks that the permit lasts.

Leave for child care, foster or family child

The workers can request leave to attend to the care of a child or foster child or other relatives. In this case, the duration of the period considered effective contribution will depend on the assumptions contemplated in the General Law of Social Security, modified with the entry into force of the Equality Law that extended the scope and duration of this benefit.

Throughout 2019, 59,446 family leave absences have been registered, of which 52,889 correspond to women, 86.96%, and 6,557, to men. The interannual variation was 4.19%, which has meant an increase of 2,389 surpluses compared to 2018.

By autonomous communities, the highest number of leave has occurred in Madrid (14,227), Catalonia (8,787), Andalusia (6,708), Valencian Community (5,406), and the Basque Country (5,567).
