The National Institute of Social Security (INSS) has managed until June 124,867 maternity benefits and 140,716 paternity benefits between January and June. Remember that these benefits have been renamed since April 1 benefits for birth and child care.
Royal Decree-Law 6/2019 of March 1 of urgent measures to guarantee equal treatment and opportunities between women and men in employment and occupation refers to birth and child care permits for the benefits that until now They were called maternity and paternity. The equalization of both permits will be completed in 2021, at which time this benefit constitutes an individual right of the parents and not transferable between them, with a duration of 16 weeks.
Social Security has dedicated more than 982.1 million euros to the payment of these benefits between January and June 2019. Of these, 703,097,373.65 euros have been allocated to the so-called maternity benefits and 279,010,417 euros to those of the parent other than the biological mother
The National Institute of Social Security (INSS) has managed until June 124,867 economic benefits of the so-called until April 1 maternity. This represents a decrease of 1.95% compared to the first half of 2018. The expenditure has been reduced by 3.78%.
Of the set of recognized benefits, the majority, 122,617, correspond to permits enjoyed by the mother and 2,250 to maternity leave enjoyed by the father. The number of maternity processes perceived by the father has decreased by 8.61%, in line with the extension of the permit that the parent other than the biological mother can enjoy, which since April is up to 8 weeks.
The amount of the maternity benefit is equivalent to one hundred percent of the salary and is paid directly by the National Institute of Social Security (INSS) during the 16 weeks of leave (expandable in case of multiple birth in two weeks for each child from the second).
In addition, the father can enjoy up to four of these weeks if the mother gives it to him. You can enjoy these shared weeks at the same time as she or below. The Law also contemplates the possibility of enjoying the permit part-time.
When the workers are charging the total unemployment benefit and go into the maternity situation, they will receive the corresponding benefit and, after exhausting it, they will resume the unemployment payment for the time that remains to be received and in the amount that corresponds at the time of the suspension.
By autonomous communities, the largest number of processes between January and June has corresponded to Andalusia (22,733), Catalonia (21,989), Madrid (21,504), and Comunidad Valenciana (12,076).
The number of processes for paternity between January and June 2019 was 140,716, 10.23% more than in the same period last year. To make this comparison, the paternity processes of the first trimester have been added with the corresponding permits to the parent other than the biological mother, as they have been renamed as of April 1. The expenditure in this semester amounts to 279.01 million euros (279.010.417), which represents an increase of 37.95% over last year.
Royal Decree-Law 6/2019 of March 1 on urgent measures to guarantee equal treatment and opportunities between women and men in employment and occupation establishes since April that the permission of the parent other than the biological mother is of 8 weeks, of which two are mandatory after birth in case of delivery. Previously, that permit was 5 weeks.
This same Royal Decree foresees that in 2020, the permission of that other parent will be 12 weeks, with four mandatory after birth in case of birth; and that in 2021, both benefits – maternity and paternity – are equalized and renamed birth and child care benefits and are recognized as an individual right and not transferable to the other parent. Its duration will be 16 weeks and 6 of them should be enjoyed after delivery.
The amount of the subsidy corresponding to the parent other than the biological mother is also 100% of the regulatory basis for the provision of temporary disability, derived from common contingencies.
The largest number of processes called until April of paternity has corresponded to Catalonia (26,940), Madrid (23,700), Andalusia (23,461) and the Valencian Community (13,793).
Leave for child care, foster or family child
The workers can request leave to take care of the child or foster child or for the care of other relatives. In this case, the duration of the period considered effective contribution will depend on the assumptions contemplated in the General Law of Social Security, modified with the entry into force of the Equality Law that extended the scope and duration of this benefit.
Until June 2019, there are 26,004 family leave leave registered, of which 23,185 correspond to applications submitted by women and 2,819 by men. The interannual variation was 6.05%, which has meant an increase of 1,484 exceedances compared to 2018.
