The transposition of the new Community Directive will lead to the updating of the national regulation of the audiovisual sector
The agents of the audiovisual sector and other interested parties may make contributions until February 22, 2019
January 21, 2019.- The Ministry of Economy and Business has initiated a public consultation to seek the opinion of the audiovisual sector agents and other interested parties regarding the transposition of Directive (EU) 2018/1808 of Parliament and of the Council of November 14, 2018. The transposition amends Directive 2010/13 / EU on the coordination of certain legal, regulatory and administrative provisions of the Member States relating to the provision of audiovisual communication services (Audiovisual Communication Services Directive), given the evolution of market realities.
The entry into force of this Directive occurred twenty days after its publication in the Official Journal of the European Union and the Member States have 21 months to carry out its transposition.
Among the main novelties introduced by the new Audiovisual Directive, the reinforcement of the protection of spectators in general and of minors in particular is highlighted by extending the scope of the regulation to video exchange services generated by users through of platforms and social networks, provided they offer services equivalent to these. Additionally, progress is being made in the harmonization of the regulation of linear audiovisual services, video on demand services and video exchange services generated by users through platforms.
The process of transposition of the directive into the national legislative framework, which will entail modifying Law 7/2010, of March 31, General of Audiovisual Communication, will be coordinated by the Secretary of State for Digital Advancement.
The objective of the previous public consultation, which is structured in 25 questions, is to have the initial contributions that can be provided by the agents of the audiovisual sector, the Public Administrations, the agents of other sectors related to the audiovisual, consumer and user associations and society as a whole, on the transposition of community regulations into the Spanish legal system.
