The Popular Parliamentary Group has registered several parliamentary questions and new requests for reports to the Government. With these parliamentary initiatives, he asks for detailed explanations on the criteria of the General State Advocacy report that the Minister of Finance wields when he states that, because he is on duty, the Sanchez Executive cannot update the deliveries on account of the common regime for 2019 , and pay the Autonomous Communities the amounts owed to them.
In the absence of formally knowing the report issued by the General Counsel of the State, invoked by the Minister of Finance to deny the possibility of the Government in charge of updating said deliveries on account, the GPP considers that the Executive is immersed in a "Political maneuver with an insolvent plot base".
The initiatives, signed by the deputy spokesmen of Economy, Mario Garcés, and Constitutional, Carlos Rojas, highlight that there are no strong arguments in the legal field to justify this impediment, “given that the update is a procedure for adjusting objective resources , not discretionary and legally established before. ” And, far from constituting a new political orientation, it is the "maximum representation of what is the normal and continuous functioning of the financial relations between the State and the Autonomous Communities".
In fact, the opposite, the lack of release of these financing funds to the different regions "will constitute an unacceptable anomaly of the system that would disturb the ordinary dispatch of issues of the Autonomous Communities."
REQUEST FOR NEW REPORTS AND QUESTIONS TO THE GOVERNMENT
For all these reasons, the GPP has requested, on the one hand, “all the reports issued by all units dependent on the General State Advocacy-Directorate of the State Legal Service, since the Government is in operation in 2019, at the request of any organ or entity of the State Administration, which have had the purpose of asking for an opinion on whether the acts, norms or any actions to be carried out by the management centers could be carried out within the framework of a functioning Government ”.
And, on the other, it has asked the Government in writing if there is any instruction, circular or internal doctrine coined by the General State Advocacy, beyond the jurisprudence of the Supreme Court, to outline the opinion that should be issued in the cases of initiatives that a functioning government can develop.
The GPP has also questioned the Executive about whether it considers a common practice that for almost eight months only verbal consultations have been dispatched with the Advocacy, if the statement of the Minister of Finance against the payments is true. And, if so, ask if you could indicate the days on which these verbal consultations took place, who made them and from which unit of that management center they responded.
In short, the GPP asks the Government to inform the representatives of the national sovereignty of the objective criteria by which it prevents the Autonomous Communities from having the resources that correspond to them to finance services as essential for all Spaniards as the Health or education. And demands that these explanations be given urgently.
