The Popular Parliamentary Group has registered a Proposal not of Law in the Congress by which it urges the Government to establish the appropriate legal dispositions, in order to establish enumeration norms that contribute to avoid illegal occupation.

In this sense, the popular demand that legislation be passed so that an illegally occupied property cannot be considered a dwelling or home, so that illegal occupants do not enjoy the same protection as those who buy a home or live in an apartment paying their rental.

Likewise, the initiative requests that the occupation of real estate cannot give rise to the registration of occupants in the municipal register, as well as that the registration in the register of an illegal occupant be considered null, does not constitute proof of their residence or domicile, nor attribute any rights to them.

Finally, the PNL establishes that the city councils will deregister, at the request of the owner or legitimate legal holder, the inscriptions of which
have knowledge.

The initiative, signed by the GPP spokesperson, Cayetana Álvarez de Toledo, the deputy spokesperson, Carlos Rojas, the PP deputy secretary, Antonio González Terol, and the Housing spokesperson, Ana Zurita, recalls that since 2015, the number of illegal occupations known has been increasing ”, reaching the figure of 12,214 in 2018.

To this we must add the resolution published by the Government on May 2, which dictates technical instructions to the City Councils on the management of the municipal Register, and that in its article 3.3 indicates that “the register is completely independent of legal-private disputes over home ownership ”.

This allows, in practice, the occupation of other people's houses to be registered in the register, even if they inhabit buildings that are not their property. And it is this permissiveness of the Government that wants to stop the GPP with this initiative.
