The Superior Court of Justice of Castilla y León has dismissed the appeal filed by the San Miguel and San Frutos Association, which requested the nullity of the donation of the controversial statue of the imp, which is located a few meters from the Aqueduct of Segovia.

The Administrative Contentious Court No. 1 of Segovia decided that it was not appropriate to take precautionary measures to prevent the placement, as well as to contest the donation made by the sculptor José Antonio Abella.

A car that has ratified the TSJCyL considering that it is a "democratic" decision that must be attributed "presumption of legitimacy" since it has been adopted within a municipal corporation in the exercise of its own powers and applying a legal norm with the rank of law.

Likewise, it has shown that the rights and interests of the actors "are neither damaged nor irretrievably damaged" by the municipal action.

Finally, the magistrate has stressed that the need to appeal to the principle of religious freedom, in its aspect of public expression, as well as to the secularity, independence and non-confessional nature of the State which, in his opinion, requires this court to remain " neutral "and assess the legality and the absence of risk against other principles that are the subject of the lawsuit.

The statue of the faun is located in the upper part of San Juan street, it is made of bronze, it is 1.70 meters high and it is held with a pincers by an ashlar.
